Plaintiff and defendant entered into a contract for the respective sale and purchase of Cherco Meal under an oral agreement. The contract provided for installments on a weekly basis, with payment by the defendant to be made within 10 days of the receipt of the order. The defendant fell behind on payments almost immediately, and in substantial sums. The seller responded to the buyers numerous requests for payment and was assured that if the balance was paid the installments would continue. The buyer sent a check, but canceled it before it could bee deposited because a delivery driver informed the buyer that this would be his last shipment. The seller contended the buyer was in breach and brought suit, the buyer counterclaimed that the seller was in breach, and this action commenced.
