Triples American Grill, a restaurant, purchased items from Plaintiff, Cheesecake Factory Triples American Grill on a line of credit. Plaintiff’s President had reason to believe that Triples was owned as a partnership by Frank Kolk and Defendant, Bob Baines. Baines took actions that indicated that he was a partner -this included opening a company bank account, signing as the owner of Triples and through various public assertions. Plaintiff sued because Plaintiff’s president claiming that the credit was only extended to Triples because he thought Defendant was an owner, but it turned out that triples was owned by a corporation. The trial could entered judgement against the Defendant. Defendant appealed.
