Charrier v. Bell
Citation:
496 So. 2d 601 (1986)Facts
Leonard Charrier, a corrections officer and amateur archaeologist, researched colonial records and concluded that Trudeau Plantation near Angola, Louisiana, was the site of an ancient Tunica Indian village. In 1967, he obtained permission from Frank Hoshman, Sr., whom he believed was the property owner, to survey the land with a metal detector. After locating approximately thirty to forty burial plots in a circular pattern, Charrier notified Hoshman of the discovery, at which point Hoshman allegedly informed him that he was merely the caretaker, not the owner. Despite this knowledge, Charrier continued excavating for three years, ultimately uncovering approximately 150 burial sites containing beads, European ceramics, stoneware, glass bottles, iron implements, weapons, religious items, jewelry, and native pottery weighing two to two-and-a-half tons. Charrier initially concealed the source of the artifacts, telling potential buyers he found them in a Mississippi cave, but later disclosed the true location when attempting to sell the collection to Harvard University’s Peabody Museum.
