In early 1984, Moses Lake invited bids for solid waste handling services with a bid opening on April 27, 1984. Seven bids were submitted, with Superior Refuse Removal submitting the lowest bid. However, Superior’s bid and the second-lowest bidder Western Refuse both failed to sign all required pages as specified in the invitation. The third-lowest bidder, Lakeside Disposal, had properly signed all pages. At the May 22, 1984 City Council meeting, after discussion about waiving the irregularities, the Council voted 4-3 not to waive them and awarded the contract to Lakeside as the lowest responsible bidder. On July 12, 1984, recall petitions were filed against the four councilmen who voted for Lakeside, alleging abuse of discretion, contravention of public interest, and increased costs to citizens. The Superior Court determined the charges were sufficient to proceed with recall.
