Jessica Gonzales obtained a restraining order against her estranged husband, Simon Gonzales, which limited his contact with her and their three daughters. On June 22, 1999, Simon violated the order by taking the three daughters while they were playing outside their home. Jessica called the Castle Rock Police Department numerous times over several hours requesting enforcement of the restraining order, but the police took no meaningful action. At approximately 3:20 a.m., Simon arrived at the police station and opened fire with a handgun. Police returned fire, killing him. The bodies of the three daughters were subsequently discovered in Simon’s truck. Jessica sued the town of Castle Rock under 42 U.S.C. § 1983, claiming that the failure of the police to respond to her repeated reports violated her due process rights.
