On August 28, 1980, Mary Cartwright and her husband Lawrence applied to American Savings for a $90,000 home construction loan for property in the East Hammond urban renewal area. American Savings had previously approved two mortgages for Cartwright’s Columbia Avenue home in 1965 and 1977. Louis Green, American Savings’ vice president, accepted the application and ordered a credit check and appraisal. The appraiser experienced difficulty finding comparable homes in the area. According to Green’s testimony, which the trial court credited, Cartwright volunteered to provide comparable housing information but never did so, and later told Green she had personal problems to resolve. Cartwright’s testimony conflicted, denying she agreed to provide information or requested delay. The Cartwrights divorced in February 1981. In May 1982, Cartwright contacted Green again, and American Savings ultimately approved a new application in November 1982, though Cartwright obtained financing elsewhere. The trial court found no evidence of discrimination based on race, sex, or neighborhood characteristics, and found American Savings never formally denied the 1980 application.
