In December 2010, a group of Lehi City voters sought to amend two city ordinances by submitting initiatives to the city recorder for the 2011 municipal election ballot. Initiative One proposed maximum salary and total compensation limits for all salaried city employees ineligible for overtime pay. Initiative Two sought to impose city residency requirements for eighteen specified city employee positions. Both initiatives obtained more than the minimum required registered voter signatures and complied with all procedural requirements under Utah’s election code. In May 2011, the Lehi City Council determined the initiatives were not valid exercises of voter initiative power, adopting a resolution directing the city recorder to refuse ballot placement. The council concluded both initiatives were administrative in nature, potentially impaired existing contracts, and conflicted with state law requiring public hearings before salary changes.
