Cannon v. University of Chicago

Geraldine Cannon applied to the medical schools at the University of Chicago and Northwestern University but was denied admission to both. She alleged that these denials were based on her sex, in violation of Title IX of the Education Amendments of 1972. Specifically, she claimed that both schools had policies against admitting applicants over 30 years old (Cannon was 39), and that these policies disproportionately affected women who were more likely to have interrupted their education. Both universities received federal financial assistance, making them subject to Title IX. After filing a complaint with HEW and receiving minimal response, Cannon filed suit in federal court. The lower courts dismissed her complaint, holding that Title IX did not provide a private right of action for individuals to sue educational institutions for alleged discrimination.
