Campos v. Firestone Tire & Rubber Co.
Citation:
485 A.2d 305 (1984)Facts
Armando Campos was a Portuguese immigrant who could not read or write in Portuguese or English. He worked at Theurer Atlantic assembling tires, which involved placing tires on rim assemblies, putting them in a safety cage, and inflating them. Firestone manufactured the three-piece rim assembly but not the safety cage. Firestone had provided written warnings and manuals to Theurer about proper tire assembly procedures, and a safety chart was displayed in the workplace. On November 1, 1978, Campos noticed a locking element on the rim opening during inflation. Fearing an accident, he reached into the cage to disengage the air hose, at which point the assembly exploded, causing severe injuries. Campos had experienced a similar but less severe accident six years earlier. At trial, plaintiff’s expert testified that Firestone should have provided graphic or symbolic warnings for illiterate workers, though he acknowledged such warnings might have had limited effectiveness given Campos’s “instinctive” reaction.
