Raymond Campbell entered into an oral agreement with Earl Daniel, Director of TVA’s Technical Library, to reproduce thirteen sets of technical trade journals on sixteen millimeter microfilm at ninety dollars per roll. Daniel had no authority to make such purchases for TVA and acted without his superiors’ knowledge. Campbell photographed, developed, and processed three hundred thirty-six rolls of film, placed them in cartridges, and delivered them to the TVA Technical Library at Muscle Shoals, Alabama. The cartridges were placed on library shelves and available to patrons for approximately two months, with evidence showing three cartridges were each used once. Daniel then returned the microfilm to Campbell by registered mail, stating there was no contract, he lacked authority, and the price was excessive. Campbell refused to accept the returned film. The original journals that Campbell had microfilmed were destroyed upon Daniel’s instruction during the microfilming process.
