David Gonzalez Camacho entered into an exclusive agency contract with Daniel Pesqueira’s parents on April 1, 2010, giving him the right to represent Pesqueira in baseball contract negotiations. In 2012, the Boston Red Sox invited Pesqueira to spring training, but later sent him back to Mexico, stating that he belonged to a Mexican league team (the Diablos Rojos or “Red Devils”) and could not play in MLB without that team’s consent. Major League Baseball provided copies of contracts allegedly signed by Pesqueira with the Red Devils covering the 2009, 2010, and 2011 Mexican baseball seasons. Plaintiffs claimed these contracts were fraudulent, with signatures that had been “lifted” from other documents. Plaintiffs filed suit against MLB and related entities, asserting claims for interference with economic relations, interference with prospective economic advantage, declaratory relief, negligence, and unfair business practices. Critically, Plaintiffs sought a judicial declaration as to whether Pesqueira was bound to the Red Devils, but did not join either the Red Devils or the Mexican League as defendants in the lawsuit.
