Flagship Properties, Inc. (“Flagship”) (defendant) was the developer of a project called “ConnTech,” which called for the construction of housing, a hotel, a convention center, and several industrial buildings near the University of Connecticut. Flagship entered into an oral agreement with C.R. Clewin, Inc. (“Klewin”) (plaintiff), with the latter acting as the construction manager for ConnTech. Klewin began work on the first phase of ConnTech, for which it had a written agreement. By the time the first phase was completed, Flagship was dissatisfied with Klewin’s work and replaced it with another construction manager. Klewin brought suit against Flagship for breach of contract for the work on the entire project.
