The agent allegedly made misrepresentations about the quality of the land, including statements about its soil quality, timber resources, and suitability for farming. Byers visited the area but did not thoroughly inspect the specific parcel he was purchasing. After completing the purchase, Byers discovered that the land was of inferior quality compared to what had been represented. He then sought to rescind the contract on grounds of fraudulent inducement, claiming that he relied on the agent’s misrepresentations when deciding to purchase the land.
