On June 4, 2015, the Oklahoma Governor signed Senate Bill 642 into law with an effective date of November 1, 2015. The legislation contained four sections: Section 1 amended existing law regarding consent requirements for minors seeking abortions and granted enforcement powers to the Attorney General and District Attorneys; Section 2 directed the Oklahoma Bureau of Investigation to create forensic protocols for statutory rape investigations; Section 3 directed the Oklahoma State Department of Health to develop new licensing and inspection protocols for abortion facilities; and Section 4 imposed substantial felony and civil penalties (up to $100,000) for violations of any existing abortion-related regulations. Dr. Larry Burns, acting on behalf of himself and his patients, challenged the constitutionality of SB 642 under the single subject rule, arguing the provisions were unrelated and forced legislators into an all-or-nothing choice. The district court found the legislation constitutional, but Burns appealed to the Oklahoma Supreme Court.
