Bullcoming v. New Mexico
Citation:
131 S.Ct. 2705 (2011)Facts
Bullcoming was suspected of drunk driving. Police, pursuant to a warrant, drew a sample of Bullcoming’s blood and sent the sample to a state-run laboratory for testing. Caylor administered the test, and signed a certification that the test was properly administered and contained large traces of alcohol.
At trial, the State did not call Caylor to testify, instead called Razatos (also a scientist at the laboratory) but one who did not directly participate in the processing of the test.
