Budge v. Post

Donald Budge, a former Wimbledon tennis champion and Davis Cup winner, entered into an employment contract with Troy Post in 1978 as partial settlement of a prior federal lawsuit in Texas. The contract required Budge to serve as tennis professional at Post’s clubs, resorts, and hotels for five years, working seven months each year, and expressly provided that Texas law would govern the agreement. Post assigned Budge to the Cambridge Towers Tennis & Racquet Club in Las Vegas where Budge began work in October 1978. A few months later, Post discontinued payments to Budge and terminated their business relationship, claiming that Budge had violated the contract by failing properly to perform his duties as tennis professional. Budge filed suit contending that Post breached the contract by failing to pay agreed compensation and by wrongfully terminating the agreement. After a three-day trial, the jury returned a verdict in Budge’s favor.
