Brower v. Ackerley
Facts
Jordan Brower (Plaintiff) filed suit against Christopher and Theodore Ackerley (Defendants) for assault. Defendants engaged in billboard advertising in Seattle, while Plaintiff is an outspoken critic of billboard advertising. Plaintiff claimed that Defendants regularly made threatening and harassing phone calls to Plaintiff. After Plaintiff learned that Defendants’ communications company failed to get proper billboard permits from the city and did not provide the city with an accurate accounting of billboards, Plaintiff filed a separate lawsuit against the city and the company when the city failed to take any action. In this separate lawsuit, Plaintiff sought enforcement of the billboard regulations. As a result, Plaintiff started to get the calls from Defendants for around 20 months. After the trial court dismissed Plaintiff’s assault claim, Plaintiff appealed.
