On June 8, 1995, Donald and Joan Brophy applied for a thirty-year fixed-rate Veterans Affairs mortgage from Chase Manhattan Mortgage Corporation to purchase residential real estate. In connection with their application, they received a Good Faith Estimate and an Initial Regulation Z Disclosure. The Good Faith Estimate showed a Loan Origination Fee of $886.38 (one percent of the loan), a Loan Discount of zero dollars, and a Mortgage Insurance Premium of $1,738. When the Brophys settled on July 31, 1995, the actual Settlement Statement listed a Loan Origination Fee of $1,902.02, a Loan Discount of $885.07, and a VA Funding Fee of $2,607. The annual percentage rate remained constant at 7.5 percent throughout. The Brophys alleged these discrepancies constituted violations of RESPA, TILA, Pennsylvania consumer protection law, and state tort law.
