In 1975, when Brooke Shields was 10 years old, her mother signed consent agreements with photographer Garry Gross allowing him to photograph the nude child for publication in a Playboy Press publication called “Sugar and Spice.” The agreements granted Gross unrestricted rights to use the photographs. Shields was paid $450 for the photo session. Several years later, as Shields’ acting career flourished, Gross licensed the photographs for use in other publications and for display in galleries. In 1981, at age 16, Shields sought to disaffirm the consent agreements and prevent further use of the photographs, claiming they were causing her embarrassment and humiliation as her career developed.
