Broadcom alleged that Qualcomm possessed patents essential to the implementation of the UMTS standard, a third-generation standard for mobile wireless telephony. During the standard-setting process, Qualcomm committed to European Telecommunications Standards Institute (ETSI) and other SDOs that it would license its WCDMA technology on FRAND terms. The SDOs relied on this commitment when they incorporated Qualcomm’s technology into the UMTS standard. After the standard was adopted and the industry became locked in, Qualcomm allegedly reneged on its FRAND commitments by demanding discriminatorily higher royalties from competitors and customers who used chipsets not manufactured by Qualcomm. Qualcomm also allegedly exploited its existing monopoly in CDMA chipsets to obtain a monopoly in the emerging UMTS chipset market by offering discounts and incentives to cell phone manufacturers who used only Qualcomm chipsets. Additionally, Broadcom claimed that Qualcomm acquired Flarion Technologies, a competitor in developing technologies for future standards, to extend its monopolies into future generations of standards.
