Brad Michael L. was born on November 7, 1977, to Catherine L., who was unmarried at the time. Catherine never established Brad’s paternity or sought child support. In 1992, when Brad was approximately fifteen years old, Catherine wrote to Lee D. informing him he was Brad’s father and requesting his name be added to the birth certificate so Brad could enroll in Lee’s tribal roll (Stockbridge) to qualify for college grants, as Brad did not have sufficient Menominee blood from Catherine’s side. Catherine explicitly stated she was not asking for money. When Lee did not respond, Catherine contacted Milwaukee County’s Child Support Enforcement office and learned that while the statute of limitations barred her and the State from bringing a paternity action, Brad could file under § 893.88. The Legal Aid Society filed a paternity action on Brad’s behalf. Blood tests established 99.96% probability of Lee’s paternity, which he admitted, and the parties stipulated Lee had no knowledge of Brad for fifteen years. During those years, Lee had married, fathered two children, and successfully operated a farm and logging business with his wife.
