Property Keyed to Rabin
Bowlin v. Keifer
Citation:
Supreme Court of Arkansas, 1969; 246 Ark. 693, 440 S.W.2d 232Facts
On April 26, 1947, Guy G. Wade conveyed his interest in the subject property to the Appellee. This deed was later recorded to give notice. On September 10, 1948, Guy G. Wade died leaving Victor Grady Wade as his only heir and on December 5, 1966, Victor and his wife conveyed one-seventh interest in the property to Appellant.
Appellant filed suit against Appellee to claim ownership of the one-seventh interest. Appellee argued that Appellant had no interest in the property and that he knew of the conveyance from Guy G. Wade to Appellee. However, Appellant argued that the deed is void and not sufficient notice because it does not describe the property. The lower court ruled in favor of Appellee. Appellant appealed.
