John Bournias was employed as a seaman on respondents’ vessel when it changed from Panamanian to Honduran registry. His employment terminated on December 27, 1950. Bournias filed a libel on December 29, 1952, claiming extra three-months’ wages payable upon change of registry under the Panama Labor Code, along with amounts for vacation, overtime, and holiday pay. He also sought penalties under federal law for failure to pay these amounts promptly and recovery for advances improperly deducted from his pay. The respondents asserted that the claims under the Panama Labor Code were barred by Article 623 of that Code, which imposed a one-year statute of limitations on labor contract actions. The district court agreed with respondents, holding that the Panama statute of limitations barred the claims and consequently the penalty claims also failed.
