William and Jill Borra married in 1978 and had two children, William (age 18) and Erik (age 11). The parties joined Tuxedo Country Club in 1984, paying the initial bond and monthly fees from joint marital funds, though membership was in the husband’s name per club regulations. During the marriage, the wife was extensively involved in club activities, chairing functions, hosting dinner parties, arranging golf tournaments, assisting in fundraising, and attending business meetings. The children regularly participated in golf lessons, tournaments, swimming, and other club events. After the parties separated in April 1999, both continued using club facilities and encountered each other only once without incident. Following the divorce filed in October 1998, the club membership went to the husband as part of equitable distribution. As a non-member, the wife would be limited to guest privileges (once every thirty days), while the children could continue regular participation in club activities. The wife applied for independent membership at her own expense. The husband intended to formally object to her application, stating he would feel uncomfortable and embarrassed encountering her at the club, especially if he were with another woman.
