Boro v. Superior Court of San Mateo County
Citation:
163 Cal. App. 3rd 1224, 210 Cal. Rptr. 122 (1985)Facts
Daniel Boro approached a woman and falsely identified himself as a doctor. He told her that she had a dangerous, highly infectious and potentially fatal disease that he had detected by looking at her through a special pair of glasses. Boro claimed the only treatments were a painful and expensive surgery that would cost $9,000 or sexual intercourse with a man who had been injected with a special serum that would cure the disease. He offered himself as this “donor,” claiming he had been injected with the curative serum. Believing his claims and fearing for her life, the woman consented to sexual intercourse with Boro. After the encounter, she became suspicious and contacted the police, leading to Boro’s arrest and prosecution.
