Robert Boese (plaintiff) was a forensic chemist hired by American Family Insurance to analyze Virginia Weathers’ (defendant) home, which was destroyed in a fire. He determined an accelerant was present. The insurance company denied the defendant’s claim and the State of Kansas filed two counts of aggravated arson against her. The defendant was found not guilty and she sued the insurance company, obtaining $8 million in damages. A few years later, a new show run by Paramount Pictures Corporation (defendant), ran a story about the fire and the trial, showing footage of Boese testifying and Weathers claiming that everyone involved in the investigation had lied. The plaintiff sued the defendants for defamation and false light as an invasion of privacy. The defendants’ moved for summary judgment.
