The village of Kiryas Joel in Orange County, New York, is an enclave of Satmar Hasidim, practitioners of a strict form of Judaism. The residents live a highly religious lifestyle, speaking Yiddish, following strict religious practices, and educating their children in private religious schools. However, these private schools did not provide special education services for handicapped children. Initially, the Monroe-Woodbury Central School District provided these services at an annex to a religious school in Kiryas Joel, but discontinued this arrangement after Supreme Court decisions in 1985 prohibited public school teachers from working in religious school buildings. When handicapped Satmar children were then required to attend public schools outside their community, they experienced “panic, fear and trauma” due to cultural differences. Most parents withdrew their children from these schools. In response, the New York legislature passed Chapter 748 in 1989, creating a special school district following the village boundaries. The district operated a secular public school providing special education services to handicapped children. The school employed non-Hasidic staff and followed the curriculum of other public schools. Two-thirds of the students came from outside Kiryas Joel, and non-handicapped village children continued to attend private religious schools.
