Dr. Ira Gore, Jr. (plaintiff), sued BMW of North America (defendant), nine months after purchasing a new car from them for failing to disclose that the car had been repainted before he purchased it. He sought $500,000 in compensatory and punitive damages and costs. At trial, the defendant admitted to adopting a company wide policy that repainted cars damaged in the course of manufacture or transportation, and sold as new so long as the damage did not exceed 3 percent of the car’s retail price. The plaintiff bought the car for $40,750.88, and the repaint cost the defendant $601.37
