The plaintiff, Bi-Metallic Investment Company, owned real estate in Denver, Colorado. In 1914, the State Board of Equalization and the Colorado Tax Commission ordered a 40% increase in the valuation of all taxable property in Denver. This order was made without providing individual hearings to affected property owners or the Denver assessor. The plaintiff filed suit to enjoin the implementation of this order, arguing that the lack of opportunity to be heard violated due process rights under the Fourteenth Amendment. The Colorado Supreme Court upheld the order, and the plaintiff appealed to the U.S. Supreme Court, challenging the constitutionality of the state’s action in denying property owners an opportunity to be heard before implementing the across-the-board increase.
