Bi-Metallic Investment Company v. State Board of Equalization

Bi-Metallic Investment Company owned real estate in Denver, Colorado. The State Board of Equalization and the Colorado Tax Commission issued an order increasing the valuation of all taxable property in Denver by 40%. Neither the plaintiff nor any representative of the city and county of Denver was given an opportunity to be heard before this order was issued, other than the notice provided by the legally fixed meeting time of the boards. The plaintiff sought an injunction against the implementation of this order, arguing that the lack of opportunity to be heard constituted a deprivation of property without due process of law in violation of the Fourteenth Amendment. The Supreme Court of Colorado sustained the order and dismissed the suit, leading to this appeal to the U.S. Supreme Court.
