Betty L. Besta initially obtained a loan from Beneficial Finance Company of Iowa (Loan I) in 1981 for $1,000.00, which was structured with a cash advance of $1,249.33, insurance premiums of $214.02, and recording fees of $15.00, creating a loan principal of $1,478.35 to be repaid over 36 months at 24% annual percentage rate. After making 18 of 36 payments on Loan I, Besta needed $500.00 to finish her basement and contacted Dial Finance for a loan. BFC employee David Mootz learned of this inquiry and contacted Besta at home, offering to arrange financing through BFC. All terms for the new loan (Loan II) were discussed over the telephone, and Besta signed the prepared documents on May 2, 1983. Loan II provided $500.00 in requested funds but was structured with a cash advance of $1,442.23, insurance premiums totaling $972.00, and recording fees of $184.00, creating a loan principal of $2,598.23 to be repaid over 72 months at 28.09% annual percentage rate with total repayment of $5,400.00. Expert witness Katherine Keest testified without dispute that the same loan over 36 months would have cost Besta only $2,541.88 total with monthly payments $5.00 less than the 72-month loan. Shortly after obtaining Loan II, Besta was laid off from her job and fell behind on payments, prompting her to file a rescissionary action to prevent foreclosure.
