On October 20, 1991, Brian Yarusso was riding his off-road motorcycle at a motocross track while wearing full safety equipment including a Bell Moto-5 helmet. The helmet met federal DOT standards and Snell Foundation certification. While traveling over dirt moguls, Yarusso was catapulted over the handlebars and landed on his head, sustaining a burst fracture of the C5 vertebral body that rendered him quadriplegic. The helmet’s owner’s manual stated that “the primary function of a helmet is to reduce the harmful effects of a blow to the head” and that the helmet “is designed to absorb the force of a blow” through its outer shell and crushable inner liner. Yarusso claimed the helmet’s liner was too stiff to adequately crush upon impact with the dirt surface, transmitting excessive force to his neck and causing his paralysis.
