Beachcomber Coins, Inc. v. Boskett
Citation:
400 A.2d 78, 166 N.J. Super. 442 (1979)Facts
Beachcomber Coins, Inc., a retail coin dealer, purchased from Ron Boskett a dime purportedly minted in 1916 at Denver for $500. Such coins are rare and valuable to collectors. Boskett had acquired this coin along with two others of minor value for a total of $450. Before purchasing, Beachcomber’s principal spent between 15 and 45 minutes examining the coin. Shortly after the purchase, Beachcomber received an offer of $700 for the coin, contingent upon certification of its authenticity. When the American Numismatic Society examined the coin, they determined it was counterfeit, with the “D” mintmark (signifying Denver) being fraudulently added. Beachcomber then sought to rescind the contract and return the coin for a refund of the purchase price.
