Neil Barry and Bernard Cohade were employed as carpenters by DeLuca Construction Company. On February 26, 1998, they were putting shingles on the roof of the New Canaan Nature Center when the platform staging on which they were working collapsed, causing them to fall to the ground and sustain severe injuries. The platform was constructed using roof brackets designed and manufactured by Quality Steel Products and purchased from Ring’s End. Evidence showed that the roof brackets were defective, specifically that the platform arm of the bracket was thinner than required by Quality Steel’s own specifications. There was also evidence that DeLuca may have violated OSHA regulations by failing to provide additional fall protection, and that one of the plaintiffs’ coworkers may have installed some brackets using smaller nails than recommended. The jury found that the defendants’ product was defective and a proximate cause of the plaintiffs’ injuries, but also found that the combined conduct of DeLuca and its employees was an intervening cause that superseded the defendants’ liability.
