Bannister (Appellee) sued Town of Noble, Oklahoma (Appellant), alleging negligence for personal injuries arising out of a one-car accident that occurred in the Town. As Bannister drove, he encountered a dump truck and road crew workers filling potholes. To avoid a collision with the truck, he swerved into the opposite lane but collided with a road crew worker, causing him to swerve off the road, resulting in severe injuries. At trial, the district court admitted into evidence three videotapes that it had viewed, illustrating the impact the injuries had on Bannister’s daily routine. The jury issued a verdict in favor of Bannister.
