Minor Child was born December 15, 2007, to Biological Mother and Biological Father, who lived together intermittently. Biological Father was incarcerated multiple times after the child’s birth and was last incarcerated on February 9, 2011. After Biological Mother’s newborn tested positive for multiple drugs in April 2011, the Cabinet filed a neglect petition listing only Biological Mother as responsible for neglect. Biological Father, incarcerated throughout the proceedings, was not appointed counsel during the neglect case. The children were placed with Adoptive Parents in June 2011, who were later granted permanent custody. Biological Father had minimal involvement in Minor Child’s life, providing only occasional supplies before incarceration. He was appointed counsel only after the Adoptive Parents filed their adoption petition in July 2012. At the adoption hearing, Biological Father testified he had been incarcerated for at least three of the child’s five years, had no employment prospects upon release, and would likely live in a halfway house.
