Autocephalous Greek-Orthodox Church of Cyprus v. Goldberg and Feldman Fine Arts, Inc.
Citation:
917 F.2d 278 (1990)Facts
In the early sixth century A.D., Byzantine mosaics were affixed to the Kanakaria Church in Lythrankomi, Cyprus, where they remained for centuries as sanctified holy relics. Following the 1974 Turkish invasion of Cyprus, Greek Cypriots were forced to flee northern Cyprus in 1976. In the late 1970s, vandals looted the Kanakaria Church and removed the mosaics. The Republic of Cyprus learned of the theft in November 1979 and immediately began worldwide efforts to locate and recover the mosaics, contacting UNESCO, international museums, scholars, and auction houses. In July 1988, Indiana art dealer Peg Goldberg purchased four mosaic pieces in Switzerland for $1,080,000 from Aydin Dikman, a Turkish antiquities dealer, under highly suspicious circumstances involving forged export documents. Goldberg conducted only cursory inquiries and failed to contact disinterested experts, the Republic of Cyprus, or the Church. When Goldberg attempted to resell the mosaics, Dr. Marion True of the Getty Museum contacted Cypriot officials, leading to this lawsuit filed in March 1989.
