Antitrust Keyed to Sullivan, 8th Ed.
Associated General Contractors of California, Inc. v. California State Council of Carpenters
Citation:
459 U.S. 519, 103 S.Ct. 897, 74 L.Ed.2d 723 (1983)Facts
The Union and Associated had maintained collective-bargaining relationships for over twenty-five years, with wages and benefits totaling more than $750 million annually. The Union’s amended complaint alleged that defendants conspired to abrogate and weaken collective-bargaining relationships through various means, including coercing landowners and contractors to hire nonunion firms and encouraging members to subcontract with nonunion entities. The complaint alleged this conduct was designed to weaken and restrain the trade of certain union contractors and to restrain the Union’s business activities. However, the complaint provided only vague descriptions of the alleged coercion, did not identify specific victims, made no allegations about market-wide effects, and failed to specify any particular component of the claimed $25 million in damages. The complaint did not allege termination of collective-bargaining agreements, reduction in union market share, decline in union membership, or decrease in union revenues from dues.
