Marybeth Armendariz and Dolores Olague-Rodgers were hired by Foundation Health Psychcare Services in July and August 1995 for positions in the Provider Relations Group, later receiving supervisory positions with annual salaries of thirty-eight thousand dollars. Both employees signed employment application forms and separate employment arbitration agreements containing identical arbitration clauses as conditions of employment. On June 20, 1996, they were informed their positions were being eliminated and they were terminated. During their employment, they alleged their supervisors and coworkers engaged in sexually-based harassment and discrimination, claiming termination because of their perceived or actual heterosexual orientation. The arbitration agreement limited remedies to wages earned from discharge until arbitration award, excluding other remedies including reinstatement, injunctive relief, punitive damages, and front pay.
