Facts
Responding to rising numbers of immigrants who were in the state illegally, Arizona in 2010 enacted a statute entitled to Support Our Law Enforcement and Safe Neighborhoods Act. Its stated purpose is to “discourage and deter the unlawful entry and presence of aliens and economic activity by persons unlawfully present in the United States. The Attorney General challenged four provisions as inconsistent with the Constitution. Two provisions were new state offenses. Section 3 makes failure to comply with federal alien registration requirements a state misdemeanor. Section 5(C) makes it a misdemeanor for an unauthorized alien to seek or engage in work in the State.
