In 1985, Congress amended the Animal Welfare Act to require the Secretary of Agriculture to establish “minimum requirements for a physical environment adequate to promote the psychological well-being of primates.” After extensive notice and comment procedures spanning several years, the Secretary issued final regulations in 1991. These regulations combined engineering standards (specific requirements for cage sizes, environmental enrichment, and restraint limitations) with performance standards (requiring facilities to develop plans addressing primates’ social needs according to professional standards). The regulations addressed over 240 species of non-human primates with widely varying needs. Jurnove challenged these regulations, arguing they impermissibly delegated the Secretary’s responsibility by allowing facilities to develop their own plans and by deferring to on-site veterinarians. The district court agreed, holding that the regulations failed to set adequate standards, particularly regarding social housing of primates.
