The Animal Legal Defense Fund (ALDF) brought action against Provimi Veal Corporation under the Massachusetts consumer protection statute, alleging that Provimi engaged in unfair and deceptive trade practices by failing to disclose information about how veal calves are raised. According to ALDF, the calves purchased by Provimi are raised in dark, confined pens, fed iron-deficient diets to produce white meat, and given subtherapeutic doses of antibiotics. ALDF claimed this treatment is cruel and potentially harmful to human health, as antibiotic use in animals can lead to antibiotic-resistant bacteria that may cause human illness. ALDF members asserted they would not purchase veal if they knew about these practices. ALDF sought an injunction requiring Provimi to disclose this information to consumers, arguing that withholding it violated Massachusetts consumer protection law because it denied consumers information relevant to their purchasing decisions.
