Anderson v. O’Brien
Citation:
2005 WL 3624382 (Conn. Super.)Facts
Anderson (Plaintiff) was an elderly widow, and the O’Briens (Defendants), a married couple, sought to purchase her home. The O’Briens’ attorney, Peter Manko, told Anderson that he would represent her interests and convinced her to sign a closing document selling her home to the O’Briens without reading it to her or addressing her concerns. None of the closing documents addressed Anderson’s life estate in the propery. Anderson filed a lawsuit against the O’Briens and Manko, alleging that Manko engaged in fraudulent representation and breach of his fiduciary duty to her as her attorney.
