In early 1975, Bessemer City, North Carolina sought to hire a new Recreation Director responsible for managing recreational facilities and developing programs for residents. A five-member selection committee (four men and one woman chairperson) was appointed to choose the director. Eight people applied, with Phyllis Anderson being the only female applicant. Anderson was 39 years old with degrees in social studies and education, experience as a classroom teacher supervising recreational activities, past employment as a hospital recreation director, extensive civic involvement, and knowledge of sports, public speaking, money management, and various arts. The committee instead hired Donald Kincaid, a 24-year-old recent college graduate with a degree in physical education. All four male committee members voted for Kincaid while the female chairperson voted for Anderson. Evidence showed that male committee members questioned Anderson about whether her husband approved of her application and whether she could handle night work, questions not seriously posed to male applicants. One committee member testified he believed it would be “real hard” for a woman to handle the job, and another had recruited only male applicants.
