The Evelyn S. Plummer Trust, established in 1967, outlines provisions for supporting Mrs. Plummer during her lifetime and for providing payments to her daughter, Vivian Miller, and her family after Mrs. Plummer’s death. After Vivian’s passing in 1992, the trust required that upon the death of both Vivian and her husband Grant E. Miller, the estate be divided among their children at different stages of their lives. Once the final payment to the grandchildren was made, the trust was to be distributed to a scholarship fund. Since all the grandchildren are over 35, and Grant E. Miller has relinquished his rights to the monthly payments, the Millers and the University of Wyoming agreed to terminate the trust. However, the Trustee refused to do so, leading the appellees to seek a court declaration for termination.
