In response to overwhelming asbestos litigation that had clogged court dockets nationwide, 20 former asbestos manufacturers (the CCR defendants) sought to resolve all current and future asbestos claims through a global settlement. The settlement was negotiated between CCR and attorneys who had previously represented thousands of plaintiffs with pending asbestos claims. These attorneys purported to represent the interests of future claimants as well, though they had no attorney-client relationship with such individuals. The proposed settlement established a complex administrative system to compensate class members who met defined medical and exposure criteria, with payment schedules for different categories of disease. The settlement included no inflation adjustment, limited opt-out rights, and extinguished certain claims recognized under state law. The class was extremely diverse, including individuals with various diseases, different exposure histories, and claims arising under the laws of different states. The District Court certified the class and approved the settlement, but the Third Circuit vacated the certification, finding that common questions did not predominate and that representation was inadequate.
