Constitutional Law Keyed to Choper
Allgeyer v. Louisiana
Citation:
65 U.S. 578 (1897)Facts
E. Allgeyer & Co. were cotton exporters in New Orleans who had obtained an open marine insurance policy from the Atlantic Mutual Insurance Company of New York. The policy required Allgeyer to notify the company by mail when cotton shipments were made. The New York insurance company had not complied with Louisiana’s insurance regulations. When Allgeyer mailed a letter from Louisiana notifying the company of a cotton shipment to be covered under the policy, Louisiana prosecuted them under Act No. 66, which prohibited any person from doing “any act in this State to effect insurance on property then in this State” with a non-compliant foreign insurance company. Louisiana claimed the act of mailing the notification letter constituted a violation of the statute, even though the insurance contract itself was made and to be performed in New York.
