Parents of African American children attending public schools in districts undergoing desegregation brought a nationwide class action against the IRS. They alleged that the IRS was not fulfilling its obligation to deny tax-exempt status to racially discriminatory private schools, as required by the Internal Revenue Code and the Constitution. The plaintiffs claimed two injuries: first, that they were harmed by government financial support to discriminatory schools through tax exemptions; and second, that the IRS policy impaired their children’s ability to receive an education in desegregated public schools by contributing to “white flight” to private schools. The plaintiffs sought declaratory and injunctive relief requiring the IRS to adopt stricter standards and procedures for identifying discriminatory schools and denying them tax exemptions.
