Baby Girl was a child classified as Indian because she is 1.2% Cherokee. Her birth parents were engaged and during birth mother’s pregnancy, their relationship deteriorated and they ended their engagement. The birth mother then asked the birth father to pay child support, which he declined to do. She then decided to put Baby Girl up for adoption and selected the Adoptive Couple, non-Indians living in South Carolina, to adopt Baby Girl. After learning of the adoption proceedings, the biological father requested a stay on the adoption proceedings, seeking custody and stating that he did not consent to Baby Girl’s adoption.
