In 1962, Congress amended the Federal Food, Drug, and Cosmetic Act to require manufacturers of prescription drugs to print the “established name” of drugs “prominently and in type at least half as large as that used for any proprietary name” on labels and other printed materials. The Commissioner of Food and Drugs promulgated regulations requiring the established name to accompany “each appearance” of the proprietary name on labels and in advertisements. The pharmaceutical industry challenged this “every time” requirement as exceeding the Commissioner’s statutory authority. The manufacturers faced a dilemma: either comply with the regulations at significant expense by changing all their materials or risk serious penalties for non-compliance. The government argued that the statutory scheme precluded pre-enforcement review and that the case was not ripe for adjudication.
